Dustin Diamond wants to delay his four month jail sentence while he appeals the case.

The 38-year-old actor - known for his role as Screech in 'Saved By The Bell' - was convicted of carrying a concealed weapon and disorderly conduct during a Christmas Day bar brawl in Wisconsin.

He was due to begin his jail term on Sunday (28.06.15) but filed a motion to appeal with a hearing set for Thursday (02.07.15).

His attorney, Thomas Alberti, said that the actor is ''resolved to serve his sentence and get this behind him.''

During sentencing earlier this month, Judge Paul Malloy told the court that wanted to ''send a message to the community that we're just not going to live like this''.

On hearing the sentence, Dustin told the court: ''I sincerely apologise to everyone involved. This was the single most terrifying experience of my life.

''This is all I've been able to think about for the last six months.''

Witnesses testified that the fight was started by Dustin's girlfriend Amanda Schutz, who shoved one woman at the bar and grabbed the hand of another. She was fined for disorderly conduct.

In last week's hearing, Dustin claimed he used the pocketknife to try stop the group from hurting his girlfriend but then accidentally stabbed the victim during the altercation.

He has also been sentenced to 15 months' probation and was ordered to pay the victim $1,105 in restitution.
