Dan Rosen and associates at Shame on You Productions filed the suit last year (14), accusing Banks and the

production companies behind the movie, about a respected TV reporter's one-night stand, of stealing his screenplay for a film titled Darci's Walk of Shame.

Rosen, who filed a copyright and breach-of-implied-contract complaint, claimed he met with Banks and her husband, Max Handelman, about the proposed film in 2007, but they decided not to go ahead with the project.

When Walk of Shame came out, the plaintiff filed suit against Banks, Handelman, Sidney Kimmel Entertainment, Film District and Lakeshore Entertainment, claiming the film was ripped from his idea.

But, in court on Friday (14Aug15), U.S. District Judge Margaret Morrow ruled that Rosen's case failed to satisfy her, stating, "Many of the purported similarities... flow directly from the basic premise of a walk of shame."

She added, "Walk of Shame is the story of a conservative news anchor whose goal in life is to achieve perfection. Darci’s Walk of Shame is primarily a romantic comedy."

The lawsuit was dismissed.
