Najee Smith was arrested by police officers in New York City in September (15) after allegedly causing a disturbance at a restaurant. He was subsequently charged with criminal trespass and released from jail.

On Thursday (10Dec15), the prosecutor overseeing the case announced she wanted to drop the charges because she felt it would be difficult to score a conviction.

"The people are moving to dismiss this case as we cannot prove it beyond a reasonable doubt," Hannah Yu said.

Judge Laurie Peterson subsequently dismissed the case and sealed all documents.

Smith declined to comment as he exited the courthouse.
