Kelly Rutherford's custody court order has been put on hold.

The former 'Gossip Girl' star, who has been locked in a bitter legal battle with ex-husband Daniel Giersch since 2012, was ''ecstatic'' when a Los Angeles judge granted her temporary sole custody of their son, Hermes, eight, and daughter Helena, five, last week and ordered they be immediately returned to the US from Monaco, where they have been living with their father for two years.

But Judge Maren E. Nelson put the order on hold on Friday (29.05.15) after Daniel's attorney suggested the 46-year-old actress ''made fraudulent statements, and lied and made misrepresentations by omission'' in a bid to win custody in new court documents.

Judges in Monaco and L.A. are scheduled to discuss the case together on June 11, and the children will remain in the care of their father until then, according to E! News.

Kelly was previously left heartbroken after her attempts to get her children back were dismissed by a federal judge.

She said at the time: ''My children, not only were they taken away, but they were sent to a foreign country. I don't know how you even explain to someone what it feels like! I could sit here and tell you how often I cry. I could tell you how it feels to leave my kids in a foreign country.''
