Kelly Rutherford is afraid her children will just ''disappear''.

The 'Gossip Girl' actress has been locked in a bitter custody battle with her ex-husband DANIEL GIERSCH over their two children, Hermes, eight, and Helena, six, and admits she fears she might not see them again.

She told The Hollywood Reporter: ''I'm just afraid. They lived on a boat in Monaco for awhile and I think Daniel could put them on one again. If he's allowed to keep them there, they could just disappear into the night and I might never see them again ...

''I found out he wasn't who I thought he was at all ... I was naive. I was totally taken in by him. Then, he totally changed. Now, he's gone, and he's got our kids and yet he and his lawyer are calling me a kidnapper and a child abductor. Nobody understands it, and I don't blame them. I don't understand it myself.''

The dispute reached a head when Kelly refused to send her kids back to Daniel in Monaco after they spent the summer with her in the United States. A judge subsequently ordered for the kids to be sent back.

The 46-year-old actress' lawyer said at the time: ''It was a Kafka-esque ambush proceeding that left the public in shock.

''The kids were put on a plane just 24 hours after the father filed papers demanding that his own children be taken into custody on the grounds that they were at risk of being abducted. He lied.''
