Hollywood superstar Scarlett Johnasson is set for a bitter battle to keep physical custody of her three-year-old daughter Rose with estranged husband Romain Dauriac claiming he wants to raise his child in his native home of France - and is prepared to take the matter before a judge.

The actress and her former partner split after two-and-a-half years of marriage but Romain has petitioned to get full custody of his daughter, claiming his ex-wife cannot manage her busy work schedule alongside bringing up their child.

In a statement Romain's lawyers said: "He plans to petition the court to allow him and his daughter to move to France.

"He [Romain] believes that her schedule makes it impossible for her [Scarlett] to have physical custody - unless she intends to have her children raised by nannies and helpers."

While the star of the Avengers has remained tight-lipped about the custody battle, she released a statement about the split and said for the sake of her own and her daughter’s privacy she would not be discussing the matter.

She said: "As a devoted mother and private person and with complete awareness that my daughter will one day be old enough to read the news about herself, I would only like to say that I will never, ever be commenting on the dissolution of my marriage.

"Out of respect for my desires as a parent and out of respect for all working moms, it is with kindness that I ask other parties involved and the media to do the same. Thank you."

Scarlett has opened up about her work life balance and has revealed she makes sure she puts work behind her to concentrate on her daughter.

Speaking about motherhood, the Ghost in the Shell actress said: "Even when I was shooting [Ghost in the Shell] I was still nursing.

"That is a very grounding [thing]. If you ever needed to return to yourself, that is a pretty wonderful way to come back to yourself when you go home."
