James Woods has filed a $10 million defamation lawsuit against an anonymous Twitter user. The 68-year-old actor and his legal representatives filed the suit in Los Angeles Superior Court on Wednesday (29th July).

The user, known as ‘Abe List’, reportedly responded to Wood’s tweets about President Barack Obama and Caitlyn Jenner but continued to insult Woods in a series of tweets. The user began his “campaign” in December 2014 which was intended, Woods’ representatives argue, “to discredit and damage Woods’ reputation”. According to reports in the L.A. Times, the user alleged Woods had taken cocaine. In other tweets, Abe List reportedly described Woods with such unpleasant terms as “joke,” “ridiculous,” “scum” and “clown-boy.” 

Legally, the crux of Woods’ defamation argument rests on Abe List’s accusation of Woods’ alleged cocaine use. According to THR, this is a statement and not, like the aforementioned adjectives, a matter of opinion. 

Woods is also claiming his privacy was breached by representing him “before the public in a false and outrageous light.”

As for how you find an anonymous Twitter user, it is as complicated as it seems at first glance. According to legal experts speaking to L.A. Times, Twitter will be receiving a subpoena. Twitter’s legal team may be able to file a motion to quash the subpoena. 

It’s also fairly difficult to sue an anonymous user as the first amendment to the U.S. constitution protects the right of those speaking who wish to remain anonymous. 

Furthermore, should the anonymous user’s identity be revealed, Woods’ lawyers will have to prove Abe List made the comments maliciously. 

It is uncertain if Woods took steps to block Abe List after receiving the tweets but Twitter has since removed Abe List’s account.
